Founders Terms & Conditions

Founders is a scheme operated by us. We are Panache Cruises, Inc, a Delaware corporation, and our registered address is 19 Kris Court, Newark, DE 19702

Clients are automatically signed up to Founders loyalty programme on completion of your first booking with Panache Cruises. By earning, redeeming, purchasing, and/or receiving gifted Founders, you agree to be bound by the provisions set out below. If you do not agree to be bound in this way, do not continue to access or use the Founders loyalty programme and all Founders points accrued shall be lost. We may modify these provisions at any time. Any such modifications are effective immediately from the time they are included on our website. You agree to review these provisions regularly to ensure you become aware of any modifications to them and by continuing to access or use the Founders loyalty programme you agree to be bound by the revised terms and conditions.

There will be other terms and conditions which govern the booking of any cruise, including those of third party providers

• “you or Member” means any member of the Founders Loyalty programme
•  “we, us or our” means Panache Cruises.

1. Membership

1.1 To be eligible to earn Founders Points you will have completed your first cruise Vacation booking with Panache Cruises.

1.2 You must be 21 years old or over, and able to provide a valid name, email address, postal address, date of birth and telephone number.

1.3 You will be sent your Founders membership card and will begin earning Founders Points from your first booking. To check the number of your Founders Points you hold, ask your Cruise Connoisseur.

1.4 Joining Founders means you will automatically be added to our marketing lists, you can unsubscribe by clicking the unsubscribe link on any email, this will however cancel your membership and all awarded points would be lost.

1.5 It is your responsibility to keep us informed of any changes to your contact details or circumstances that could affect your Founders membership.

2. Earning your Points

2.1 Founders Points are earned as follows:

2.2 Founders points are combinable with Panache Cruises sales and discount campaigns. Founders points are NOT combinable with Panache Cruises best price guarantee.

2.3 Founders points will only be awarded to a new booking, points cannot be added retrospectively unless authorised by a Director of Panache Cruises.

2.4 Founders Points earned on a new booking will be awarded to the lead name on the booking only.

2.5 Founders Points gifted by us for a booking will be awarded to the lead name on the booking only.

2.6 Cruises booked on board by Members will earn Founders Points once the cruise booking has been officially logged as a booking on Panache Cruises reservations system.

2.7 In the event of a change to any element of a booking including to Cruises, hotels, transfers, tours and any additional elements, including any change in the number of passengers travelling, awarded Founders points will be adjusted accordingly.

2.8 Founders points are non-transferable.

2.9 Founders Points can be purchased at a cost of 1cent per point with a minimum purchase of 500 points.

2.10 Purchased Founders points will be awarded to the person purchasing unless an alternative member has been elected to receive the points as a gift at the time of purchase.

2.11 Purchased Founders Points are non-Refundable and must be redeemed within 24 Months.

3. Redeeming your Founders Points

3.1 Each point redeemed is worth 1cent against your cruise.

3.2 Founders points have no monetary value except when being redeemed against a new cruise booking made via Panache Cruises with a preferred supplier.

3.3 Founders Points can be redeemed on ‘booked on board’ bookings with our preferred cruise line partners once the cruise booking is officially logged as a booking on our reservations system.

3.4 Founders Points cannot be redeemed against the same booking they were earned.

3.5 Founders Points can only be redeemed against bookings made with our preferred suppliers. Any suppliers that do not qualify will be advised prior to booking.

3.6 Founders Points can only be redeemed when advising your connoisseur of your wish to do so at the time of booking.

3.7 Founders Points must be redeemed within 24 months of being awarded. Unused points will be automatically removed from your account in month 25 if they have not been redeemed.

3.8 Should you cancel or amend your booking, awarded points will be adjusted accordingly. If your points have already been redeemed against a new booking, these points would also be adjusted and any outstanding balance as a result would need to be paid via an alternative payment method.

3.9 Founders Points remain the property of Panache Cruises, Founders offers can be withdrawn at any time when reasonable notice has been given.

3.10 For points to be redeemed against any booking, the Founders member must be the lead passenger travelling.

3.11 If a cruise is cancelled by the cruise line or by Panache Cruises and Founders Points have been redeemed on that booking, the Founders Points will be returned to the members account.

3.12 Founders Points cannot be redeemed against deposits and/or advance registrations.

3.13 Restrictions may apply where Founders Points cannot be redeemed in conjunction with any other discount or discount voucher issued by us, or by our cruise line partners.

3.14 If a booking is cancelled where Founders Points have been redeemed, Founders points will be lost unless otherwise authorised by a Director of Panache Cruises. For transparency points can only be returned to the members account if the booking is cancelled at just loss of deposit. Once cancellation charges apply, points are likely to be lost.

4. Your Founders Points account

4.1 All members will be sent a “ Recommend a Friend email “ once per year, to forward on to your friends. Your friends must register from the unique link in the email for your Founders Points to be awarded, or manually enter your Recommend a Friend Code when prompted to do so. Your email address will be your recommend a friend code.

4.2 You will be awarded 1,000 Founders Points for each of the first 5 friends who book automatically making them a Founders member. Maximum bonus points per calendar year is 5000.

4.3 Your friend must be over 21 and not already on the Panache Cruises database.

4.4 Bonus Founders Points will automatically be credited to your account within 7 days of your friend booking.

4.5 Panache Cruises may change or withdraw this offer at any time and without prior notice.

4.6 We reserve the right to remove any duplicate Founders memberships and any associated points awarded in duplication will be forfeited.

4.7 You will receive regular points updates via email, points balances can also be checked by calling or emailing your connoisseur.

4.8 We reserve the right to terminate your membership if it has been found that Founders Points have been purchased or used, or attempted to be used, fraudulently.

5. General

5.1 Questions, Queries and/or Complaints should be addressed to your connoisseur in the first instance. Escalated issues should be addressed to [email protected].

5.2 If we do not enforce a term of these terms and conditions straight away, this does not mean we cannot/ enforce such a term at a later date.

5.3 Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

5.4 Any failure by us to comply with the terms and conditions due to any events outside of our reasonable control (force majeure), including but not limited to acts of God, war, civil commotion, explosion, flood, fire, labour disputes, malicious damage, riot, strikes, supplier delays, terrorism, earthquake, actions of government or any other event or incident, shall not be deemed a breach of these terms and conditions.

6. Our Liability

6.1 We cannot accept responsibility for any unauthorised spending of your Founders Points balance, online or otherwise. It is your responsibility to ensure that all information relating to your Founders membership is securely stored, and redemption of your Founders Points are carried out securely and appropriately.

6.2 We shall have no liability for claims that arise from you not being able to access the scheme or our website or any interruption, or a failure to complete a transaction.

6.3 Nothing in these terms and conditions shall exclude or limit any of your statutory rights which may not be excluded or limited to you acting as a consumer. Any provision which would be void under any consumer protection legislation or other legislation shall to that extent, have no force or effect.

6.4 Panache Cruises reserves the right to:

• (a) terminate any Founders membership at any time without notice if we believe that the Member has acted in a way that may harm or has harmed the business. These actions include but are not limited to: hostile, abusive or aggressive behaviour towards staff; knowingly providing us with false or misleading information, illegal or fraudulent activities, or failure to comply with these terms and conditions.
• (b) amend or terminate the Founders Points scheme. This includes changing the value of the points at any time, upon reasonable notice period.
• (c) add or remove additional preferred partners to the Founders Points scheme at any time.

7. Data Protection

We will not pass on your details to any third parties (unless required to do so in the performance of this scheme or where the law either requires/allows us to do so) without your consent being obtained. Please see the privacy policy on our website for more information on data protection. By joining Founders, claiming and/or spending Founders Points, you consent to our processing your personal data as follows: to implement and manage your Founders Points and associated bookings and to provide you with marketing in relation to similar services provided by us.

8. Jurisdiction

These terms and conditions are governed by the laws of laws of the United States and the jurisdiction of the State of Delaware.
